We believe it is important for you to understand what types of information we are collecting and what may happen to that information when using our website and related applications and resources (collectively, the “Service”). This Privacy Policy is designed to explain MAG Foundation’s policies and procedures with respect of collection, use and disclosure by MAG Foundation of information about you in connection with the Service. This Privacy Policy has a limited scope and applies only to the Service.

Collection of information
We collect information about you in a variety of ways in connection to the Service. MAG Foundation will be the controller of your personal data processed in connection with the Service, and can be contacted here.

Registration
To use some features and resources available through the Service, a user must complete our registration process. During registration, a user is required to provide certain categories of information, which may include personally identifiable information and other information about you such as your name, address, e-mail address, social network account information, password, user type, birthdate, gender, phone number, and how you heard about MAG Foundation.

Optional information

At various other points during your use of the Service, you may have the option to provide additional information related to you. For example, you may wish to create a profile, post, comment on another user’s post or share a post with another person, or you may wish to utilize social network integrations or location-based features of the Service. For voluntary activities like these you have the choice about whether to disclose the information necessary to use these features of the Service.

Passive collection of information
In addition to the information which you actively provide to us by methods such as completing our registration process, commenting on, or sharing a post, we collect information about how you interact with the Service. We collect passive information for purposes such as testing and improving user experience with the Service and the compilation of demographic data and related usage information for internal purposes and for disclosure to third parties such as advertisers and business partners. CCPA
California consumers may use the Digital Advertising Alliance’s tool to send requests under the California Consumer Privacy Act (“CCPA”) for a web browser to opt out of the sale of personal information by some or all of that framework’s participating companies by accessing the DAA’s tool here: https://www.privacyrights.info/, or by downloading the DAA’s AppChoices mobile application opt-out here:  https://www.privacyrights.info/appchoices.  

The AppChoices app is not limited to opt-outs for CCPA purposes and may be used by anyone to limit the collection of cross-app data for interest-based advertising purposes by participating DAA member companies.
If you are a California resident, you have rights in relation to your Personal Information; however, your rights are subject to certain exceptions. For instance, we cannot disclose specific pieces of Personal Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personal Information, your account with us or the security of our network systems.

Right Against Discrimination - You have the right not to be discriminated against for exercising any of the rights described in this section. We will not discriminate against you for exercising your right to know, delete or opt-out of sales.

Right to Know - You have the right to request in writing: (i) a list of the categories of personal information, such as name, address, email address, that a business has disclosed to third parties during the immediately preceding calendar year for the third parties' direct marketing purposes, and (ii) the names and addresses of all such third parties. In addition, you have the right to request: (i) the categories of personal information we have collected about you, (ii) the categories of sources from which personal information is collected, (iii) the business or commercial purpose for the information collection, (iv) the categories of third parties with whom we have shared personal information, and (v) the specific pieces of personal information we hold about an individual. You have the right to request a copy of the specific Personal Information we collected about you during the 12 months before your request.

Right to Delete - You have the right to request us to delete any Personal Information we have collected from you or maintain about you, subject to certain exceptions.To assert your right to know or your right to delete your Personal Information, please contact us according to the “Contact Us” section below. To verify your identity, we may ask you to verify Personal Information we already have on file for you. If we cannot verify your identity from the information we have on file, we may request additional information from you, which we will only use to verify your identity, and for security or fraud-prevention purposes.

Right to Opt-Out of Selling. As described in this Privacy Policy, in certain situations we may share your Personal Information with certain third parties for our marketing or other purposes. To the extent such sharing is considered a “sale” under the CCPA, as a California resident you have the right to opt-out of such sharing.

General Data Protection Regulation (GDPR)
If you are in the European Union, you have certain rights under the General Data Protection Regulation in relation to your personal data:

Access - You are welcome to request MAG Foundation for copies of your personal data. We may charge you a small fee for this service.
Rectification - You may request that MAG Foundation correct any information you believe is inaccurate. You may also request MAG Foundation to complete the information you believe is incomplete.
Erasure - You may request that MAG Foundation erase your personal data, under certain conditions.
Restriction of processing - You may request that MAG Foundation restrict the processing of your personal data, under certain conditions.
Objection to processing - You may object to MAG Foundation's processing of your personal data, under certain conditions.
Data portability - You may request that MAG Foundation transfer the data that we have collected to another organization, or directly to you, under certain conditions.If you make such a request, please be sure to include your contact information. We will reply within 30 days. If you would like to exercise any of these rights, please contact us.
Should you wish to report a complaint or if you feel that we have not addressed your concern in a satisfactory manner, you have the right to lodge a complaint with your local data protection authority.

Collection of information from minors
This service does not knowingly collect any Personal Information from children under the age of 13. If you are under the age of 13, please do not submit any Personal Information through our Service. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Policy by instructing their children never to provide Personal Information on our Service without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Information through our Service, please contact us, and we will use commercially reasonable efforts to delete that information from our databases.

Electronic mailing lists and how to unsubscribe
We may use your contact information periodically in order to send you email or other communications regarding updates to the Service and to alert you or remind you of happenings related to the Service. The frequency of these messages will vary depending upon various factors.If you no longer wish to receive e-mails from us and want to be removed from our electronic mailing list, please contact us and include “Email Unsubscribe” in the body of your message.

Terms of Service


There are some simple ground rules you'll need to agree to before using MAG Foundation. Playing by these rules is a mandatory part of using our application, so if you have any questions about them, please drop us a line and we'll respond posthaste.

MAG Foundation agreement
By using or signing up for MAG Foundation, you are agreeing to be bound by the following terms and conditions (the “Agreement”).By marking the applicable "I have read and agree to the terms of service" checkbox, you hereby agree to the Agreement.

1. MAG Foundation services
In exchange for your payment of the applicable subscription fee, you may request MAG Foundation services, as described on our website at https://app.mag.foundation. We will provide the MAG Foundation services in accordance with this Agreement and the other terms and conditions described on our website at https://app.mag.foundation.

2. MAG Foundation account
To become a customer, you must complete an order form and create an account by providing first name, last name and company name (if applicable), email address, and any other information indicated as required. We may reject any order form or application for an account for any reason, in our sole discretion. You acknowledge that we will use the email address provided by you as the primary method for communication. You are responsible for keeping your account password secure. We cannot and will not be liable for any loss or damage arising from any failure to maintain the security of the account and password.If you place an order and sign up for an account on behalf of your employer, your employer will be deemed to be the customer for the purpose of this Agreement, and you represent and warrant that you have the authority to bind your employer to this Agreement. Each customer is responsible for assuring that its employees, agents and subcontractors comply with this Agreement.

3. Fees
You will pay a fee for your subscription as specified in your MAG Foundation order form. Fees are based on the subscription term and not actual usage, and fees paid are non-refundable.

4. Termination
Either party may terminate this Agreement at any time, with or without cause, effective immediately upon written or electronic notice. Upon termination of this Agreement, all rights granted to you hereunder will immediately cease, including but not limited to the right to access the Account, unless otherwise determined in our sole discretion.

5. Intellectual property rights
You agree not to provide us with any confidential or proprietary information. Each party acknowledges and agrees that the other party may freely use and otherwise commercially exploit any ideas, feedback or suggestions provided by it to the other party.

6. Disclaimers and limitation of liability of warranty
THE SERVICES ARE PROVIDED “AS-IS” AND WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.NEITHER PARTY WILL HAVE ANY LIABILITY WITH RESPECT TO THE SERVICES OR OBLIGATIONS UNDER THIS AGREEMENT OR OTHERWISE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSSES OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING IN ANY WAY FROM THE SERVICES. IN ANY EVENT, EACH PARTY’S LIABILITY UNDER THIS AGREEMENT FOR ANY REASON WILL BE LIMITED TO THE FEES PAID BY YOU DURING THE SIX MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM FOR DAMAGES. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING, BUT NOT LIMITED TO, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATIONS, AND OTHER TORTS. THESE LIMITATIONS APPLY EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

7. General provisions
This Agreement sets forth the entire agreement and supersedes any and all prior agreements, written or oral, of the parties with respect to the subject matter hereof. We reserve the right to update and change the Agreement prospectively by posting updates and changes on our website, https://app.mag.foundation. You are advised to please check the Agreement from time to time for any updates or changes that may impact you. If a significant change is made, we will provide reasonable notice by email and an opportunity to terminate this Agreement if you do not agree with the change.The parties to this Agreement are independent contractors. Neither party is an agent, representative or related entity of the other party. Nothing in this Agreement is intended to create, nor will it be construed as creating, any exclusive arrangement between the parties to this Agreement. This Agreement does not restrict either party from entering into similar arrangements with others. Each party understands that the other party may now or in the future be involved in developing or providing competitive products or services. Neither party is liability for any failure or delay caused by any circumstance or event beyond its reasonable control.
